Terms of Service
These Terms of Service ("Terms") govern your use of everadam.com and any related subdomain, and any mockup, design, hosting, or maintenance service ("Service") provided by EverAdam ("we," "us," "our"). By submitting a form on this site, accepting a mockup, or paying an invoice, you ("Client") agree to these Terms.
The short version: You request a free mockup. We deliver it in 48 hours. If you approve it, your site goes live and you pay $100/month with a 6-month minimum term. After month 6 you can cancel anytime with 30 days' notice. On cancellation, your site goes offline — or you pay a one-time $497 export fee to keep the code and design files.
1. The Free Mockup
- You request a custom website mockup by submitting the form on this site. There is no charge.
- We deliver a preview ("Mockup") to the email you provide within 48 hours of receiving the complete brief. We may ask clarifying questions; the 48-hour clock starts once we have what we need.
- You have 5 business days from delivery to approve, decline, or request light revisions.
- If you decline, you owe us $0. No payment, no follow-up obligation. The Mockup files remain our property and are not transferred to you.
- If you do not respond within 5 business days, the offer expires and the Mockup is closed with no charge.
2. Going Live — The $100/Month Plan
- Once you approve the Mockup, we will issue an invoice for the first month: $100 USD.
- Billing then continues monthly, on the same calendar day, at $100/month, billed in advance.
- Your site goes live within 5 business days of first payment.
- All prices are in US Dollars and exclude any sales tax that may apply in your state.
- We may suspend service after 7 days of non-payment, and terminate after 30 days of non-payment, with notice.
3. What's Included in the $100/Month
- Premium hosting on enterprise infrastructure (US data center).
- SSL certificate, security monitoring, and routine security patching.
- Unlimited content updates (text, images, contact info, hours, service descriptions) submitted by email.
- Mobile + Core Web Vitals optimization, reviewed quarterly.
- Monthly performance report.
- Direct email support during US business days.
4. What's Not Included
- Custom development beyond the standard one-page site (e.g. e-commerce checkout, booking engines, custom integrations, member portals). These are quoted separately, one-time, with a written estimate before any work starts.
- Domain registration. Your domain is registered by you, in your name, on your registrar account. You pay your registrar directly. This is intentional — you always control your domain.
- Paid advertising management. We do not run Google Ads, Meta Ads, or any paid campaigns on your behalf.
5. 6-Month Minimum Term
- By approving the Mockup and starting your subscription, you commit to a minimum of 6 monthly payments ($600 total). This covers our build cost since you paid nothing upfront.
- If you cancel before month 6, the remaining months of the 6-month commitment become immediately due as an early-termination charge.
- After month 6, the subscription continues month-to-month with no further commitment until you cancel.
6. Cancellation
- After your 6-month minimum, you may cancel at any time by emailing contact@everadam.com.
- Cancellation takes effect 30 days after we receive your notice. You pay one final monthly invoice covering that notice period.
- At the end of the notice period, your site is removed from our hosting and goes offline — unless you exercise the export option below.
7. Export Option ($497, One-Time)
- At any time during or after the 6-month minimum, you may pay a one-time $497 USD export fee to receive a full copy of: your website's HTML, CSS, JavaScript, all images and design assets we created for you, and basic deployment instructions.
- Once paid and delivered, the exported files are yours to use however you wish. Ongoing hosting, updates, security, and support from us end at the conclusion of any active billing cycle.
- The $497 fee is independent of any monthly fees owed.
8. Ownership
- EverAdam owns the website code, design files, and hosting infrastructure for as long as you are an active subscriber, unless you have paid the export fee under Section 7.
- You own: your domain, your brand assets you provided to us, your business content (text and images you provided or that we wrote about your specific business), and any user data collected through the site.
- Underlying conversion frameworks, templates, and tooling used to build many client sites remain the property of EverAdam.
9. Refund Policy
- The free Mockup is fully refundable in the sense that it never costs anything. If you decline it, you pay $0.
- Monthly subscription fees are non-refundable once a billing period has started. We bill in advance for the upcoming month of service; if you cancel mid-month, the current month is not pro-rated.
- The 6-month minimum is not refundable — if you cancel before month 6, the remaining months are due as an early-termination charge (Section 5).
- The $497 export fee is non-refundable once we have delivered the files to you.
- If we fail to deliver the agreed Service due to our fault (extended downtime, failure to perform requested updates), contact contact@everadam.com and we will work in good faith toward a credit or partial refund.
10. Client Responsibilities
- Provide accurate business information, brand assets (logo, photos if available), and contact details.
- Respond to clarifying questions within a reasonable time so we can meet the 48-hour Mockup window.
- Confirm you have the legal right to use any content (text, images, logos) you provide to us.
- Keep your billing method current.
11. Acceptable Use
You may not use the Service for content that is illegal, fraudulent, hateful, sexually explicit, or that infringes third-party intellectual property. We may suspend or terminate service for violations, with reasonable notice except in cases of clear illegality.
12. Limitation of Liability
To the maximum extent permitted by law, EverAdam's total liability arising from or related to the Service is limited to the total amount you paid us in the 12 months prior to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business opportunities.
13. No Guarantee of Business Results
While we build conversion-focused sites, we do not and cannot guarantee a specific number of leads, sales, conversions, or revenue. Outcomes depend on your industry, traffic, offering, market conditions, and many factors outside our control.
14. Limited Capacity
Because we hand-build every Mockup, we limit the number of free Mockups per week and the number of active client builds in our pipeline. Availability shown on our homepage reflects open slots as of that moment and is subject to change without notice.
15. Changes to Service or Price
We may change features included in the $100/month plan at any time with reasonable notice. We may change the monthly price for new clients at any time. For existing active subscribers, the monthly price will not increase during your first 12 months of active subscription. Any price change after that will be communicated at least 30 days in advance, and you may cancel before the change takes effect.
16. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware.
17. Changes to These Terms
We may revise these Terms from time to time. The version in effect at the time of your subscription start applies to that subscription until renewal. Material changes will be reflected by an updated "Last updated" date above and, for active subscribers, communicated by email.
